'Ministry's Permission Authorization Annulled'

Criminal lawyer Associate Professor and Prime Ministry Human Rights former Chairman Dr. Vahit Bicak, said the condition of getting permission from the Ministry of Justice in order to open a case for the article 301 is a procedural rule; the ministry has no longer such an authorization according to the new code.

(Today's Zaman, 22.12.2005) Whether the case about Turkish author Orhan Pamuk, currently on a court-ordered recess, will continue or not is at the heart of public discussions in Turkey. Criminal jurists advocate the ministry"™s authorization for permission annulled in accordance with the new Turkish Penal Code (TCK). It is legally impossible for the ministry to make a decision on the permission issue, since authorization in this regard is procedural, and that with an amendment the authorization squashed, the jurists defend. Professor Bahri Ozturk, one of the jurists the Ministry of Justice asked for views, said the ministry has no permission authorization about the continuance of the Pamuk case. Ozturk recalled in the new code that came into effect in 1 June 2005, there is no condition of getting permission from the Ministry of Justice about the article 301, for which Pamuk is tried.
